ARTICLE 4 - GENERAL PROVISIONS
- The parties to this contract are the Buyer and the Seller, and all obligations and responsibilities regarding the fulfillment of this contract belong to the parties. This agreement enters into force on the date it is electronically approved by the Buyer.
- The Buyer accepts, declares and undertakes that he has read and understood all the information regarding the features and sales conditions of the product subject to the contract specified in Article 3, and has given the necessary approval for the purchase of this product.
- The seller is responsible for the complete delivery of the product subject to the contract, in accordance with the qualifications specified in the order.
- If the Buyer requests the Product he purchased to be delivered abroad, all customs procedures, expenses, taxes, duties and charges that may arise due to the shipment of the Product abroad belong to the Buyer.
- If the product price is not paid for any reason or is canceled in bank records, the Seller is deemed to be free from the obligation to deliver the product.
- If the relevant bank or financial institution does not pay the price of the product to the Seller due to unfair or unlawful use of the Buyer's credit card by unauthorized persons after the delivery of the product, which is not due to the Buyer's fault, suspend the Buyer's membership on the website until the relevant payment is made. rights reserved.

- The Buyer accepts, declares and undertakes that, in accordance with the provisions of the legislation in force, the provisions regarding interest and default interest will be applied within the scope of the credit card agreement between the bank and the Buyer.
- If the purchase is made by credit card and in installments, in cases where the Buyer exercises his right of withdrawal or in cases where the desired product cannot be supplied for various reasons or in cases where a refund is decided to the Buyer by the decisions of the Consumer Arbitration Committee; The credit card refund procedure is specified in article 4.11.
- The bank repays the price to the consumer in the same number of installments as the buyer purchased the product in the same number of installments. After the Seller pays the entire product price to the bank at once, in case the installment expenditures made through the bank POS are refunded to the Buyer's credit card, the requested refund amounts will be transferred by the bank to the holder's accounts in installments in order to prevent the parties involved in the matter from being victimized.
- In case of returning the product by card, the Seller cannot pay the Buyer in cash, in accordance with a separate agreement with the bank. Since the Seller is obliged to pay the relevant amount to the bank in cash or by deduction in case of a refund, it will not make a cash payment to the Buyer in accordance with the procedure. For refunds to a credit card, the refund will be made to the card by the bank after the Seller pays the fee to the bank at once.
- The Seller will use its best efforts to resolve the Buyer's complaints regarding the issues arising from this contract within a reasonable time and manner. The Buyer may direct any complaints to the Seller by sending an e-mail to info@popandsandy.com .

ARTICLE 6 - DEFAULT PROVISIONS
- In case the parties do not fulfill their obligations under this contract, Articles 123-125 of the Code of Obligations. The Debtor's Default provisions in the article will apply. In cases of default, if any party does not fulfill its obligations within the specified period without a justified reason, the other party will give 7 days to the non-performing party to fulfill the obligation in question. If it is not fulfilled within this period, the right to demand delivery of the product and/or termination of the contract and refund of the price will arise by requesting the performance of the performance from the party that has not fulfilled its obligation.
- If the Seller cannot deliver the product subject to the contract within the deadline due to force majeure that may prevent the Seller from fulfilling this obligation; In such cases, the Buyer may exercise one of the rights to cancel the order or postpone the delivery period until the blocking situation disappears, stating that the Seller has no liability. If the Buyer cancels the order, the amount paid will be paid to him within 10 (ten) days.
ARTICLE - 7 COMPETENT COURT:
Consumer Problems Arbitration Committees at the residence of the Buyer or Seller are authorized for all complaints and objections of the Buyer and other disputes that may arise regarding this contract, up to the value declared by the Ministry of Customs and Trade every year, and Consumer Courts are authorized for disputes above the said value. .
